    1. The company is a Manufacturing company.
    2. They have 17,000 employees.
    3. Yes. Salary has changed but not significantly.

    I dont see any issues here, but if you are still not sure and your date is current, see if you can request a promotion date that can be effective after your case has been adjudicated.

    It will take some explaining but might be worth it..

    lets stop this rhetoric on repubs, what about bobby jindal, marco rubio & nick haley and plz don't give explanations to distort the reality, many in the republicans sincerely support legal immigration, tell me few good things dems did to legal immigrants, aint regan the one who gave amnesty to illegals in 80s, aint bush the one who tried more than once to pass CIR, who opposed h1b fee increase recently?

    Yes my in-laws are fine and they were not disappointed seeing me in person. But I am gigling by looking at this thread is growing and at page 3 someone put a shame on this thread. As for me sometime its fun and Ok to share minor detail or personal detail to give confidence to someone doing same thing which we went thru(like I have beein using photos taken at Kinkos and Sears). Nevertheless since date is coming closer to file our 485 it makes me happy to see several smiley face and helping hands in IV forums. Glad to be helping others and ignore rants of others.

    I am just here to share my thoughts and knowledge nothing personal to anyone. So to everyone Dont worry:( ! Be happy :) .

    I called USCIS NSC yesterday and asked if my new approved I-140 was interfiled with my pending I-485. The IO asked me for my A# and then told me that she doesn't see the new I-140 starting with SRC on the system. She only sees the original I-140 with the LIN. It was very frustrating to hear this as I had called NSC a week before and the IO told me that the new I-140 is in the system and visa was available for me. However, I remembered that last week the IO did not ask me for my A#. She only asked for the receipt numbers of my pending I-485 and the new I-140.
    Friends, what else can I do to make sure that my newly approved I-140 under EB2 is interfiled?
    Speaking from my case, I called NSC for the same reason multiple times and every time the information I got (now looking back) was either useless or insignificant. Only one procedural info I got once was correct. They informed me that when you Interfile, your request goes into your file and no receipt or any other update is done to your case. When your 485 app RD becomes current and an IO picks up the case to work on it, should consider the Interfiling request. If your PD is then current due to the Interfiling request and every other detail on your 485 app is complete, your case is approved immediately. That is exactly what happened to my case. Calling them is less fruitful and more frustation. I only called them once a month after they changed their processing dates for the month just in the hope I may get lucky with an IIO who may give some info. Never did. I also took an Infopass, but that was fruitless too, as they also could not provide any information. Just asked me to wait until my RD becomes current.

    Hope this gives you some perspective and lowers your anxiety.

    I have just applied for my labour. So I can apply for 485 only after 5/6 years?:mad:

    Make thing worse....your labor expires after six months, so you have to re-apply again..and again...and again...and again...and again....

    Hi Guys,

    I am EB2 I with a priority date of April 2006 (Direct labor applied and approved from employer A, I 140 applied and approved from Employer A, Filed 485 from Employer A itself)

    Moved to Employer B using EAD in 2009 January. (Almost after 18 months after getting EAD)

    10/15/2009 i called the TSC and asked the representative to know whether my case is pre approved or not. the representative told me that he does not have any of that data and opening a SR will let us know. i opened one SR on the same day.

    I got a mail just now, with the following text in it.

    "The status of your request is

    Your case is on hold because your appear to be inadmissible under the current law

    Rather than denying your application based on inadmissibility, we are placing your case on hold while the Department of Homeland security considers additional exercises of the security of Homeland security discretionary exemption authority.

    Such an exercise of the exemption authority might allow us to approve the case."


    What does this mean, any one has some idea about it.

    This is very strange. However, I would like to know the reason that prompted you to inquire about your case status. What was the status that was showing on-line? Is it "application received and pending", the same usual statement?

    YOu can surrender your GC letting know the USCICS that, it got approved when the PD was not current. I had read this on murthy.com. Browse the website to learn more about it or contact murthy.com attorney's.

    How am I so sure...?? Even I am one amoung them praying for 485 not getting approved untill I get married. My PD is 2006, so I guess I don't have to worry too much.

    Thanks for the reply tabletpc, but my GC was approved when the PD was current. i was wondering about the options i've to get my future wife to USA.

    I think Meera Shankar needs to be fired. Its bloody 2010 and this is the kind of customer service the indian consulates provide - they dont pick up calls - it takes them a month to issue new passports - Always feel ashamed to be an indian any time I have to deal with these useless consulates.

    The Houston consulate does not even have their address properly listed on their website.

    This is what they have listed

    1990, Post Oak Boulevard,
    # 600, 3 Post Oak Central,
    Houston TX 77056

    So what is the correct address ?? Is it 1990 Post Oak Blvd or 3 Post Oak Central ?? Bunch of freaking idiots is what we have in all these US consulates.

    We can demand a purple card for any techworker who had worked and paid taxes and contributed to Social Security and medicare for three continuous years. This card should allow free travel and work permit for spouse. Counterpart of blue card for illegals......Once the priority date becomes current and adjustment of status is complete, purple card is replaced by green card !!!!!!!!

    Dish: The idea is great, if you go to the link that I posted (the official link to that proposed legislation) you will see that they talk about all the non immigrant visas and their spouses and minor children, so they should add all those same things under the H-1B parragraph in the part talking about the rights of the H-1B dependants. I do not know exactly how from a conversatioin between us goes to the IV core, and then to QGA, and then to the Senate, but anyways, this is a start.

    I read through this proposed legislature and there is absolutely nothing to worry about.
    your valid drivers license is clearly mentioned as one of the acceptable proof of legal status. you need to be arrested or there should be obvious reason to suspect ilegal presence for the law official to ask proof of legal status. Why is that of any concern? That is perfectly normal in a legal society. You dont have to walk around with your 797 or 94s all you have to carry is a valid drivers license. Even if you dont have a license you will be given a chance to proove your legal status or inother words the decision is not made on the spot.
    Again for those unfortunate who are here ilegally this law might become an issue. But we might end up seeing inflation as a result of these crack downs. More industry particularly packing/agriculture might migrate oversees. Anyway we will wait and see.

    May 14, 2008 (Computerworld) Efforts to increase the H-1B cap have been stuck in a legislative swamp, but U.S. Rep. Zoe Lofgren (D-Calif.) has introduced three bills in the last few weeks to help foreign nationals already working in the U.S. to obtain permanent residency. She announced her latest legislative effort late Wednesday.

    Fixing the permanent residency, or green card employment-based, visa program has been a top legislative goal of high-tech industry proponents, on par with their efforts to raise the H-1B cap.

    And Lofgren, who heads the U.S. House Subcommittee on Immigration, is in the position to move legislation to the head of the class. But it remains to be seen whether she can jump over the legislative stalemate created by lawmakers who want comprehensive immigration reform or nothing at all.

    Lofgren's latest bill, HR 6039, which is not yet available online, will exempt graduates of U.S. universities with advanced degrees in science and tech -- the so called STEM degrees (science, technology, engineering, mathematics) -- from the annual 140,000 limit on these permanent residency visas. The bill was officially introduced yesterday.

    In a statement, Lofgren said that more than 50% of graudates with advanced degrees in science and engineering are foreign-born. "If we want our economy to continue competing in the global market, we have to retain these foreign students so they compete with us instead of against us in other countries. These men and women are the innovators of tomorrow, and we aren't the only ones looking to retain their talents. Increasingly, employers from Europe, Australia, Canada, and even China and India, are beating U.S. employers for valuable talent," said Lofgren.

    That bill is closely tied to legislation introduced earlier this month by Lofgren, HR 5921. That bill seeks to eliminate the per-country caps on employment-based visas. The U.S. caps at 7% per country the number of employment-based visas issued to would-be visiting workers. "Because of this cap, a Chinese or Indian post-graduate at he top of his/her class at MIT may have to wait half a decade or more for a green card, much longer than a student from a less-populated country," said Lofgren, in a statement released when the legislation was announced.

    Although much of the focus has been on the H-1B cap and its 85,000-visa quota, which includes the 20,000 set aside for holders of advanced degrees, high-tech industry proponents say the difficulty in getting permanent residency for their employees is as much a problem as getting H-1B visas.

    Microsoft has about 4,000 employees for whom it is trying to gain permanent residency, said Jack Krumholtz, managing director of federal government affairs at Microsoft. They face long waits because of the green card backlog, suffering personal and professional frustrations along the way, Microsoft Corp. Chairman Bill Gates testified.

    "We only hire people that we think can contribute to our innovation and corporate bottom line over the long haul, so we move immediately to apply for green cards for you and your family members," said Krumholtz, who said Microsoft is supporting Lofgren's legislative effort.

    The typical path for a tech worker is, first, work after graduation on a student visa -- a period that was recently extended by the Bush administration from a year to 29 months -- and then an H-1B visa until employment-based permanent residency can be achieved.

    Other legislative steps taken by Lofgren include a bill that would take unused employment-based green cards and essentially roll them over for resuse in a subsequent year. That bill is HR 5882. There are Republican co-sponsors for each of these bills.

    Lofgren's across-the-aisle backers of these bills include U.S. Reps. Chris Cannon (R-Utah), Jim Sensenbrenner (R-Wisc.) and Bob Goodlatte (R-Va.).

    Ron Hira, an assistant professor of public policy at the Rochester Institute of Technology, said he believes the U.S. can absorb more highly skilled, permanent immigrants with green cards "without significantly harming the American workforce. But we have to do it the right way."

    Among the issues, says Hira, is the thorny question of "who are we going to grant employment-based permanent residence to?" Educational level attained (bachelor's, masters or Ph.D) and the academic area studied by potential residents are apt to be factors in that.

    Hira said that one "significant problem" with the Lofgren bills "has to do with using exemptions as a way around tackling the decision of how many [to grant]," and he added the plan to "recapture" was a gimmick to get around the quota issue. Among the questions Congress should look at, says Hira, is the impact of the changes; he indicated, for instance, that the legislation may change incentives, prompting foreign nationals to seek degrees from any U.S. school they can because it will be seen as a path to permanent residency.

    I too thought that it could be a hoax call. But When I discussed with my employer and came to know the name of the person who called me is same as that of person who visited our employer 2 months back, then I realized that it is not a hoax call.

    But I really don't understand what was the purpose and why I got such call and why he did not show up. Till now there is no communication from the officer.

    Do you have this "officer"'s caller id in your phone records ?
    In case it is one of your colleagues trying to fool you.

    Applied to TSC on July 23rd, got a transfer notice on Sep 28th. I applied for I131, EAD/I485. My Checks got cleared. My EAD/AP receipt still says CA, but I think they are sending I485 to original I140 apporved center ...for me TSC.

    1) Try state group insurance
    Texas and for that matter every state has a group insurance coverage for folks
    who donot get coverage from any other insurance provider.

    This is a coverage that you will get for sure, only document you will need is a written paper from insurance company that one cant be insured.

    Check the state insurance board website.

    2) check free clinics, these clinics will provide complete care ( you can pay them if you like)if you dont thats fine too. I suggest paying them if you can even if its a bit high, as someone who cant afford may one day get to use this service too.

    3) Ask yours employer's insurance agent, group insurances gurantee insurance.

    Donot worry, life works in interesting ways. As last resort one can go to home country for delivery.
