Well my friend, don't bring your pretentious "I'm-so-great-I'm-non-judgemental-oo-la-la" BS here. If we don't make it clear in our replies that we do not condone any actions that break the law, we are just making it easier for anti-immigration people to easily point fingers at us and claim we are all drug peddlers or criminal.

I would urge more members here to reply to the OP that we at IV do not have any sympathy for people breaking the law.

I am from Ohio and tried several times to join State Chapter. I did get PM from a member last week who asked me to get him my personal info, which I did but no rsponse from him..

I spoke with Uday, he has enrolled you as a State Chapter Member. There is a google/yahoo grp that each chapter leader maintains. You can directly contact Uday if you have any suggestions or he will contact you when there is any action item and the members of Ohio are participating. hello,

my qualification is 10 + 12 + 3 BSc Physics + 3 MCA. My LC clearly states that a Master's is required.

does this qualify for a US Master's? please note the fields are different.

My i-140 has been denied and waiting for notice...mostly it education and i filed under EB2 in TSC...

any input guys?????

I know so many people who got approved in EB2 with MCA degree. I don't know a single person who got denied with 3 yearc BSc + 3 Year MCA.

Can't agree more. This is nothing but harassment. What has drivers license got to do with employment or immigration status ?

I don't understand how many of our members think that this is the right thing to do. Haven't we got enough chains on us already ? :rolleyes:
I feel like this is an example of how messed up this country is becoming. I used to work in Dubai and you need to show a copy of your visa page and employer letter for things like

1. Getting an internet connection . I kid you not: DSL became available thru Etisalat and I needed a copy of my visa page before I could get an internet connection,

2.Driver's License. This one takes the cake: I needed a letter from my employer stating that HE IS OK WITH ME APPLYING FOR A DRIVING LICENSE. Not an EVL but an EAL (Employer Authorizing Letter)

What does it tell you when you reach a situation where the laws and policies within individual US states start bearing resemblance to those used by medieval monarchies.

(d) Form I-140 Petition Must be Approved Prior to a Favorable Determination of a �106(c) AC21 portability request.

this could be read 2 ways...either you need have an approved I-140 prior to filing for portability OR the adjudicator needs to approve the I-140 prior to determining portability.



According to the 2005 memorandum, it was possible to change employers even if the 140 was not approved. But it was clear that an RFE that was not responded to, would deny everything.

Now it appears, they would require an approved 140.

I-140 :Approved on Mar 2006
Invoked AC21 on September and sent all necessary docs. No LUDs then.
I think ex-employer have revoked I-140 already but not sure (He threaten me in 2007 that he will do so in I invoke AC21).

Now check this out:
Soft LUD on I-140 on 10/15/2008.
Soft LUD on I-485 on 10/24/2008.
Soft LUD on my spouse's I-485 on 10/27/2008.
Soft LUD on I-485 on 10/29/2008.
Soft LUD on I-140 on 10/30/2008.
Soft LUD on I-485 on 10/30/2008.

I am clueless! Somebody please help me! :confused:

Don't worry. Most likely, it is USCIS error. Check why after 140 approval, they sent to DOS while you are in Adjust of Status? May be USCIS entered wrong in system and creating issue.
I would take INFOPASS and contact local Congressman.

Starting July 16th, 2007, labor certification has a 60 day validity period. Meaning, a I-140 petition needs to be filed within 60 days from labor approval date....If immigrant visa numbers are unavailable (dates retrogressed), you wont be able to file your I-140/I-485 concurrently but you can file your I-140 petition irrespective of your priority date as long as you have a labor approved. You dont have to apply for your labor again and again....Its just that, once you get your I-140 approved, you will have to wait for dates to become current to file I-485...

Now, I think it is a random check and nothing like 'employer audit'. I never asked him -at that time I thought it was a part of background check.

I believe they are always doing these checks probability could be 1/100,000 although i have no idea at the frequency.
