I just wanted to share some good news. I had two approved LCs. One with PD EB3 ROW March 05 and the other with ROW EB3 March 06. I had already filed the I-140 for the March 06 but not for the March 05 one. That was because of the way the job requirement was worded in that LC. The attorney was not sure if it would be approved. Anyway since the earlier PD became current in June I decided to take a chance and file I-140 for that earlier PD LC with PP. And what do you know, it got approved today and that allowes me to file for AOS this month. It was a bit of a gamble with money but it worked!!! :cool:

I have a question. I am working for a company on a H1-b visa status. And i applied for GC using a different company as future employment and i got my EAD and AP.
What is my stand here? Can i use the EAD and work a completely different company? or do i need to transfer my H1 to the company which did my GC?
Does AC21 apply here? (Because i haven't worked for the company at all who sponsored my GC)

H1, H4 (spouse) and H4 (kid) living happily.
File 485 and gets EAD/AP.
H1 doesn't use EAD.
H4 uses EAD and hence looses H4 status.
I-485 is denied.
Now, my understanding is that spouse has to go out of country and come back again on H4.
What about the kid?
When does the kid loose his/her H4 status? (When both mother and father use EAD)?

Finally...exctly after 4 months my all checks got cleared today , and got receipt number from the back check image.
Only do't know 140 as it was employer's check.
Just to Recap
Sent 140/485/765/131 on Aug 3rd to NSC
SR opened on 11/5.. IO said it must have been transfered to TSC
Fax sent on 11/28
Check cleared on 12/3 .. Receipt # from TSC.

Well I have a BS and MBA with 1 year of experience in my current company. And they're not willing to do MBA+0. So I guess Eb3 is the only option.

Vonage, a provider of voice over Internet protocol phone service, has reached a settlement with Kentucky, Indiana and 30 other states over allegations of deceptive marketing and unscrupulous customer service procedures.
Under the agreement, Vonage will make �significant� changes to its marketing practices and handling of consumer cancellation requests. It also will provide refunds to eligible customers.
The company will pay the states a total of $3 million for reimbursement of legal and investigative costs. Kentucky�s portion of the reimbursement is $45,000, according to a news release from Kentucky Attorney General Jack Conway�s office.
Vonage officials could not immediately be reached for comment.
Vonage was ordered to provide refunds to customers who did not receive rebates they believed they were due because their accounts weren�t open long enough to qualify or because they spent a portion of their trial periods waiting to receive or return equipment.
Refunds also will be provided to customers who were assessed excess usage charges without being informed of usage limits, received additional monthly service charges because of difficulty in canceling service, or received charges for unordered services and equipment offered as free.
Under the settlement, Holmdel, N.J.-based Vonage (NYSE: VG) must revise its disclosures for offers of free services, money-back guarantees and trial periods, according to the release. The company also must follow strict guidelines in dealing with customers wishing to cancel their service.
Through their investigation, the states found that Vonage paid bonuses to customer service representatives who retained customers. As a result, many customers had difficulty canceling their service.
Now, Vonage must record and verify conversations between customers and the company�s customer service representatives, according to the release.

If USCIS approved your H-1B for employer D, and attached I-94, that means that as long as you are working for employer D at this time and at the time you extend and re-stamp your H-1b visa, there should be no problem. Make sure you take W-2s and Tax returns from previous years you were in H-1B status when you go for a new Visa Stamp.

Generally attorneys charge a retainer fee. What that means is they are willing to represent you regarding any issues with a case. Some services are covered with retainer fee and they may charge additional fee based on any extra work. For Example AC21 Retainer fee is around 750/- where they submit a G28. Then for any RFE they generally charge in the range of 250$.
Thanks for the reply. I understand the retainer fee but I guess what bothers me is why the attorney wasn't up front about the situation or simply charge for a consult then going ahead with a retainer when we simply thought there was something more involve to do with my case at the time.
Its the way that the situation was manipulated to get us to retain this attorney for further use when at the time it wasn't needed that feels fraudulent.

My EAD expires on 07/28/2010. My EAD renewal is currently pending (applied online on 5/18/2010 at NSC). My AP expires on 08/24/2010. I am planning to apply for AP renewal once I finish my move to new address.
So, I really don't know which date to put. BTW, USCIS online application didn't mark that field as required.

I have a approved I-140. Applied for 3 year H1 extension in Oct 2006. 3 year H1 extension approved on 5th Feb 2007. Received H4 dependents extensions. Did not receive my I-797. Requested my consulting company to check why I did not receive my I-797 with I-94. They lied to me that they called USCIS and I/they/lawyer will get copy in 30/45 days. My MN drivers license got canceled/suspended on 04/24/2007 because I did not submit approved I-797/I-94. Company lawyer informed my company that they applied under premium processing for duplicate copy on 04/16/2007. I called USCIS and they told me this is bullshit. There is no premium processing for duplicate document. Lawyer does not want to reveal which form he filed for duplicate document. I also applied this week using form I-824 for duplicate copy of approved H1 extension. Called USCIS, and they said I will get a receipt number in 15 days and copy in 2-3 months. This copy will not include I-94, so it is useless. What options do I have. My lawyer is an American and he thinks it is below his dignity to answer my calls.
